Arbitration
Arbitration describes the legal process by which a dispute between two parties (such as a patient and an insurer) is resolved in a binding way for both parties through the use of a third-party known as an arbiter or arbitrator. Arbitration is sometimes used in billing disputes in dental insurance.
There are important legal differences between arbitration and traditional court-decided lawsuits. Arbitration can be quicker and less expensive than the use of the court system. Arbitration decisions, though, are much harder to appeal if you disagree with the result (compared to a court decision). The details of arbitration decisions are private from the perspective of the arbiter and typically not part of the public record. However, there is the possibility that one or both parties divulging details unless there is an agreement to confidentiality.
